  • Agreements with Other Collective Administrators

    OAZA

    On 18 December 2017, Intergram concluded a representation agreement with OAZA regarding the collectively managed rights to perform works from recordings and their transmission, as well as radio and TV broadcasting. Under this agreement, Intergram grants licenses for the use of publicly released works by sound engineers ("sound masters") through public performance, transmission, and broadcasting in accordance with § 23 of the Copyright Act, and collects remuneration for such use.

    OOA-S

    On 18 December 2017, INTERGRAM entered into an agreement with OOA-S regarding the collectively managed rights to perform works through TV broadcasting. Under this agreement, INTERGRAM grants licenses for the use of publicly released works by authors through television broadcasting according to § 23 of the Copyright Act, and collects remuneration for such use.

    OSA

    On 20 December 2017, INTERGRAM signed an agreement with OSA for the representation of collectively managed rights to perform and transmit works from recordings, and to broadcast works on radio and television. Under this agreement:

    OSA grants licenses to use INTERGRAM’s repertoire through public performance from recordings and their transmission under § 20 and broadcasting under § 23 of the Copyright Act.

    OSA also grants licenses to use works represented by OAZA and OOA-S under the same provisions and collects remuneration accordingly.

  • Whistleblowing

    If you have information suggesting that unlawful conduct is taking place or might take place within Intergram, you have the option to report it. Reports should concern conduct that constitutes unlawful behavior, i.e., a criminal offense or an administrative offense punishable by a fine of at least CZK 100,000, or conduct that violates the Whistleblower Protection Act (Act No. 171/2023 Coll.) or other legislation, including EU regulations, in specific areas.

    Whistleblowers and other protected persons (i.e., assistants, subordinates, or persons close to the whistleblower) are granted protection against retaliation as provided by the Whistleblower Protection Act.

    To this end, Intergram has established an internal whistleblowing system.

    Who Can Submit a Report

    A whistleblower may be an employee, part-time worker, volunteer, trainee, intern, or applicant for such positions. Reports from other individuals who are not engaged with Intergram in any of these capacities are not accepted.

    How to Report

    Reports via the internal whistleblowing system must be submitted to the designated person:

    1. By phone, at +420 221 871 930, on business days between 9:00 AM and 5:00 PM
    2. In person, by appointment made without undue delay through the above-mentioned contact details, within 14 days of requesting the meeting

    Reports are received and processed exclusively by the designated person, who is impartial, independent, and meets the legal requirements for this role.

    Reports can also be submitted through the external whistleblowing system operated by the Ministry of Justice at https://oznamovatel.justice.cz.

    All reports are confidential, and the designated person must keep the whistleblower's identity confidential. The report must allow for the identification of the whistleblower (should include name, surname, date of birth, and residential address).

    Report Requirements

    The identity of the whistleblower or other protected persons may only be disclosed to others with their written consent or where required by law. If disclosure to public authorities is necessary, the whistleblower and others must be informed in advance.

    Reports must be clear and specific. They should identify the person being reported and the nature of the conduct to allow proper investigation. The whistleblower should state their name, surname, and date of birth, or provide other details that enable identification. Providing a phone number or email address is recommended for communication. Anonymous reports can be submitted and will be investigated; however, whistleblower protection does not apply unless the whistleblower’s identity becomes known.

    Reports do not include Rights holder complaints regarding remuneration, Users’ commercial strategies, Issues related to personal data protection, unless they involve a crime or offense as outlined above.

    Handling Reports

    The designated person assesses the validity of the report within 30 days and informs the whistleblower in writing. This period can be extended by an additional 30 days, up to twice.

    If the report is found to be unjustified or based on false information, the whistleblower is informed in writing without delay. This notice includes information on the possibility of using the external reporting system.

    If the report is justified, the designated person proposes preventive or corrective measures to Intergram. Intergram is obligated to implement the proposed or another suitable measure and inform the designated person, who then informs the whistleblower.

  • Orphan Protected Subject-Matter

    An orphan protected subject-matter refers to artistic performances, sound recordings, or audiovisual recordings whose rightsholders — such as performers, record labels, producers, or their heirs — are either unknown, unidentified, or cannot be located. In other words, this applies to a performance or recording where:

    • the identity of the rightsholder is unknown,
    • the identity is known, but the rightsholder cannot be traced or contacted,
    • the heirs of the original performer or producer are unknown or untraceable.

    The above also applies when there are multiple rightsholders and only some of them are unknown or unreachable.

    In such cases, a "diligent search" as prescribed by law may be conducted. If the search does not yield results, INTERGRAM may grant a licence for the use of such an orphan protected subject-matter.

    Currently, Intergram does not manage any orphan performances or recordings for which a diligent search has been conducted and which would thus fall under the administration of rights as orphan protected subject-matter.

  • Unidentified and Unlocated Rightsholders

    When distributing and remunerating collected royalties, we take into account only those rightsholders who are represented by a contract or have registered their rights with us.

    Below, you will find lists of recordings whose usage has been reported to us, but for which we do not know the rightsholders. Royalties allocated to these cannot be disbursed, as the rightsholders have neither entered into a contract with us nor registered their rights.

    These lists include recordings with one or more unidentified or unlocated rightsholders for the years 2021, 2022, and 2023. For easier reference, we also publish a name list of unidentified and unlocated performing artists (for 2022 and 2023) for whom we hold a payable royalty balance.

    Additionally, we are seeking heirs of deceased performing artists. Their list can be found here.

    Producers who find their recordings in the first list may directly fill in their share of the producer's rights in column "I" and send it to us at: vyrobci@intergram.cz. Performing artists who find themselves in the second list are kindly requested to contact us at: umelci@intergram.cz.

  • Licence for the Use of Out-of-Commerce Works

    There are recordings and the performances captured on them which are no longer available for purchase and can be accessed only through cultural heritage institutions such as libraries, archives, museums, galleries, etc. For such protected subject-matter, the law provides an option for these institutions (on a non-commercial basis) to make them available on their websites without the need for a licence from the rightsholder.

    The list of such out-of-commerce protected subject-matter is maintained by the National Library of the Czech Republic. In such cases, the licence from the rightsholder may be substituted with a licence granted by Intergram.
